THE INFORMATION ON THE SITE, INCLUDING ARTICLES, WEBINARS, RECORDINGS, PATIENT RESOURCES, AND LISTS OF CLINICAL TRIALS, IS FOR GENERAL INFORMATION AND EDUCATION ONLY. IT IS NOT A SUBSTITUTE FOR THE JUDGMENT OF YOUR DOCTOR OR ANOTHER QUALIFIED HEALTH CARE PROFESSIONAL WHO KNOWS YOUR SITUATION.
ALWAYS TALK WITH YOUR DOCTOR OR CARE TEAM ABOUT ANY QUESTIONS YOU HAVE ABOUT A MEDICAL CONDITION, AND BEFORE STARTING, STOPPING, OR CHANGING ANY TREATMENT. DO NOT IGNORE MEDICAL ADVICE OR DELAY SEEKING IT BECAUSE OF SOMETHING YOU READ OR WATCHED ON THE SITE.
WE DO NOT RECOMMEND OR ENDORSE ANY PARTICULAR DOCTOR, TREATMENT, PRODUCT, OR CLINICAL TRIAL. THE VIEWS OF SPEAKERS, ADVISORS, AND OTHER CONTRIBUTORS ARE THEIR OWN. MEDICAL INFORMATION CHANGES QUICKLY, AND WE CANNOT PROMISE THAT EVERYTHING ON THE SITE IS COMPLETE OR UP TO DATE.
IF YOU THINK YOU ARE HAVING A MEDICAL EMERGENCY, CALL 9-1-1 OR YOUR DOCTOR RIGHT AWAY.

Your use of third-party services is entirely at your own risk and subject to their respective terms and privacy policies. Inclusion of a third-party link does not imply endorsement. We disclaim all liability arising from your use of any third-party services.
2. Tumor Board

You represent and warrant that you have all rights and consents necessary to provide your User Content to LMCF, including permission from any other person who appears in or is described in your User Content (for example, a loved one), or that you are legally authorized to provide it on their behalf, and for LMCF to process your User Content as necessary to provide the Site.
5.2 You hereby grant to LMCF a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable (to the extent permitted by applicable law) license to host, use, reproduce, edit (for example, for length, to crop a photo, or to add transcripts, captions, or image descriptions), process, transmit, and display your User Content as necessary to provide, maintain, secure, and improve the Site, to support our mission (including on the Site, in our newsletter, on social media, and at conferences and events), to comply with law, and as otherwise permitted by these Terms and our Privacy Policy. If you sign a release or consent form for a specific program, such as our video slideshow, the terms of that release, and not this section, will govern our use of the content covered by it.
5.3 Please think carefully before submitting health information about yourself or anyone else. Your User Content submitted for tribute pages, the video slideshow, or other public features of the Site may be seen by others. We may decline to post, or may remove, any of your User Content at any time.

8.2 When we receive an infringement notice with all the required information in accordance with the foregoing and are able to locate the allegedly infringing material, we will remove or disable access to the subject material. We also will take reasonable steps to promptly notify the person who posted the subject material. We will give them the opportunity to send a counter-notification. A counter-notification must include the following, to be effective under the DMCA:
A physical or electronic signature of the person submitting the counter-notification;

The name, address, email address and telephone number of the person submitting the counter-notification;
A statement that the person submitting the counter-notification consents to the jurisdiction of the Federal District Court for his judicial district, or if the person is outside the United States, for any judicial district in which LMCF may be found, and that the person will accept service of process from the person who submitted the DMCA claim or his agent.

10. Disclaimers
10.1 THE SITE AND ALL LMCF CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” AND LMCF MAKES NO REPRESENTATION OR WARRANTY, ORAL OR WRITTEN, EXPRESS OR IMPLIED, ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INTERFERENCE, ACCURACY, OR NON-INFRINGEMENT. WITHOUT LIMITING THE MEDICAL DISCLAIMER ABOVE, YOU ARE SOLELY RESPONSIBLE FOR ANY RELIANCE ON, AND DECISIONS RELATING TO, THE SITE AND LMCF CONTENT, INCLUDING ANY ERRORS, OMISSIONS, INACCURACIES, OR INTERRUPTIONS.
10.2 Some jurisdictions do not allow limitations on implied warranties. In such cases, the above limitations will apply to the maximum extent permitted by applicable law, and any statutorily required warranties shall be limited to the shortest period and maximum extent permitted by law.
11. Limitation of Liability
11.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, ADVISORS, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, LOSS OF USE, OR COSTS OF DELAY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
11.2 TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). THESE LIMITATIONS APPLY TO ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, AND EVEN IF ANY LIMITED REMEDY IN THESE TERMS IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
11.3 YOU ACKNOWLEDGE AND AGREE THAT THIS SECTION 11 IS A FUNDAMENTAL BASIS OF THESE TERMS AND A REASONABLE ALLOCATION OF RISK BETWEEN YOU AND LMCF, AND THAT LMCF WOULD NOT MAKE THE SITE AVAILABLE WITHOUT THESE LIMITATIONS.
11.4 Some jurisdictions do not allow certain limitations of liability. In such cases, our liability will be limited to the maximum extent permitted by law. Nothing in this Section 11 excludes liability for fraud or for death or personal injury to the extent caused by our negligence.
12. Indemnification
12.1 You agree to defend, indemnify, and hold harmless us and our directors, officers, employees, volunteers, advisors, agents, licensors, and service providers (collectively, the “LMCF Parties”) from and against any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees and costs) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms or applicable law; (c) Your Data or any information that you provide to us, including its accuracy, completeness, or legality; or (d) any dispute between you and any third party.
12.2 We may participate in the defense of any claim through counsel of our own choosing, and the parties will reasonably cooperate on any defense. We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you. You may not settle any claim without our prior written consent if the settlement does not fully release us from liability or would require us to admit fault, pay any amounts, or take or refrain from taking any action.
13. Suspension; Termination
13.1 We may suspend or terminate your access to the Site at any time with or without notice for any reason, including if we believe you have violated these Terms, present a security or legal risk, or as otherwise necessary to protect the Site or comply with law. We will have no liability for taking any such action. Upon termination, your right to use the Site ceases immediately.
13.2 You may stop using the Site at any time.
13.3 Sections of these Terms that by their nature should survive termination will continue in effect, including the medical disclaimer above and Sections 2 (Tumor Board), 5 (User Content), 6 (User Responsibilities; Prohibited Activities), 7 (Intellectual Property), 10 (Disclaimers), 11 (Limitation of Liability), 12 (Indemnification), 14 (Dispute Resolution), and 15 (General Provisions).
14. Dispute Resolution
14.1 Before filing a claim against us, you agree to try to resolve the dispute informally by contacting us at info@lmcancer.org with “Dispute” in the subject line and a description of your claim. We will not be liable for any delay or failure to perform our obligations due to events beyond our reasonable control, including acts of God, war, terrorism, natural disasters, epidemics, pandemics, government actions or orders, labor disputes, internet or telecommunications failures, power failures, or cyberattacks.
15.6 Modifications to Terms. We may update these Terms from time to time by posting the revised version on the Site with an updated “Last Updated” date. Your continued use of the Site after such changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically. 15.10 Headings. Headings are for convenience only and do not affect interpretation.
15.11 No Third-Party Beneficiaries. Nothing in these Terms confers on any third party the right to enforce any provision, except as expressly provided herein.

15.13 Governing Law; Venue. These Terms are governed by the laws of the State of Colorado and the United States, without regard to conflict of law principles. The exclusive jurisdiction and venue for actions related to these Terms will be the state courts located in Boulder County, Colorado or the United States District Court for the District of Colorado, and both parties submit to the personal jurisdiction of these courts.
15.14 Waiver of Jury Trial. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND WE EACH KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION, PROCEEDING, OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE
